Terms and Conditions

These Terms and Conditions of Sale apply to all Orders that the Buyer chooses to place with RARA, and sets out all of the terms that relate to the Seller who supplies goods to the Buyer.  By signing these Conditions or by placing an Order, the Buyer is in acknowledgement and agreement that it will be bound by them.

  1. Interpretation

Within these Terms and Conditions (Terms), the following words and expressions will have the following implications. 

"the Buyer" signifies the individual, firm or organisation who buys the Goods from the Company:

"the Company" signifies RARA and any related trading names

"Contract" signifies the contract / agreement between the Company and the Buyer which will be considered to incorporate these Terms;

"Goods" signifies any products within the Contract to be provided by the company to the Buyer;

"Place of Delivery" signifies the place to which the goods are to be delivered.

Within these Terms, reference to any statue or statutory provision will be construed as a reference to any such state or statutory provision as amended, modified, re-enacted or replaced from time to time.

  1. The Contract

The Contract will be on these Terms and excludes of all other terms and conditions.  This includes any such terms and conditions which are deemed to be included or applied by the Buyer.

No terms and conditions contained in the order confirmation, purchase order, or any other order document of the Buyer will form some portion of the Contract.

  1. Delivery

Any dates determined by the Company for delivery of the Goods are proposed to be an estimate only. If a date is not specified for the delivery of the Goods, delivery will be within a reasonable time frame.

We will make every effort to ensure that delivery forecasts are met, however we cannot accept any liability for loss which occurs due to the inability to meet the delivery deadline.

Subject to any other provisions of these Terms, the Company will not held liable for any loss, regardless of whether this is direct or consequential, or an economic loss of profits, which arise directly or indirectly due to any delays in the delivery of the Goods. This will not entitle the Buyer to terminate or rescind the Contract unless the delay surpasses 60 days.

    4. Returns

We hope you will be very satisfied with your order. However, in the unfortunate event that you are not happy with your order you may return it to us in its original condition and packaging within 14-days.

Items can be exchanged if it's in original condition and packaging within 30-days. Most bracelets and necklaces can be extended or shortened for a fee.  

Items that have been made to order, or to fit a certain specification cannot be returned. 

  1. Risk in and Ownership of the Goods

Risk in the Goods shall be passed to the Buyer on delivery.

Possession in the Goods will not be passed to the Buyer until the Company is in receipt of all cleared funds and all sums due to the Company in regards to the Goods and all other sums which are, or may become due to the Company from the Buyer on any account. 

Until responsibility for Goods has been passed the Buyer, the Buyer will:

hold the Goods on a fiduciary basis as the Company's bailee;

store the Goods independently from all other Goods of the Buyer any third party in a way that the Goods are identifiable as the property of the Company.

do not destroy or deface any identifiable mark on the Goods, or on the packaging of the Goods.

Keep the Goods in an acceptable condition insured with the Company's interest noted on the policy, and hold any proceeds of such insurance on trust for the Company, and they must not be mixed with any other money. 

The user must accept at all times that the Goods ordered are suitable.  The Company will not accept liability for the way the products / goods are stored or used. 

  1. Cost

The cost for the Goods will, except when otherwise agreed, be the price set out on the date of delivery in the Company's price list. The cost for the Goods will exclude all delivery costs and insurance costs, and any applicable VAT the buyer must pay in addition. Carriage is free on all orders within England, mainland Scotland and Wales - when the value of the order is over £50 (excl VAT). For every single other region including export carriage will be charged at cost. We reserve the right to change our prices to those ruling at the date the order is dispatched.

  1. Payment

Payment is not considered to have taken place until the receipt by the Company, or of cleared funds. 

  1. Warranties

The Company warrants that the Goods are of a satisfactory quality. 

In the event that the Buyer wishes to make a claim under this warranty, the Buyer must give a written notice to the Company within 30 days of the discovering the defect, and give the Company a reasonable opportunity to investigate and inspect the Goods in question. 

The Company will not be liable for any breach of the warranty if the Buyer continues to use the Goods after notifying the Company of any alters or repairs without the agreement or consent of the Company.

The Company's obligation under the warranty will be limited to arranging repairs or a replacement of the Goods in question, or a refund of the price of said Goods.

  1. Limitation of Liability 

The Company's liability in contract, tort or in any other case emerging out of the subject-matter of the Contract will not exceed £1000 and the Company will by no means be liable to the Buyer in any circumstances for any consequential, indirect or economic loss or damages.

  1. Force Majeure

In the event that either party is subject to an event of Force Majeure, so in any circumstances out of its reasonable control, which includes but is not limited to war, industrial disputes, fire, or any civil commotion, it will inform the other and the first party's obligations under these terms shall be suspended until it informs the other party of the end of such Force Majeure 

  1. General

In the event that any part of these Terms is found to be void or unenforceable by any Court of competent jurisdiction, such part will be severed from these Terms, which will in any other case remain in full force and effect.

These Terms will be governed and deciphered by English Law and the parties submit to the exclusive jurisdiction of the English Courts.

Due to a programme of continual product development, we reserve the right to amend any specifications, designs, and prices without having to give any prior notice.  Any advertisements in catalogues, online, and any other written material are only intended to be representative of a general indication of the products which are referred to therein and in no part will be binding by us.
